1. Introduction & Acceptance of Terms

Welcome to BH Consultancies. These Terms of Service ("Terms") govern your use of the legal consultancy services, resources, and information (collectively, the "Services") provided through this website. The Services are owned and operated by BH Consultancies ("we," "us," or "our"), a legal consultancy firm based in the United Kingdom.

By accessing our website, purchasing our Services, or communicating with us, you ("Client," "you," "your") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services. These Terms constitute a legally binding agreement between you and BH Consultancies.

2. Scope and Nature of Services

BH Consultancies provides specialized online legal consultancy and support services from its base in the United Kingdom. Our services are directed at emerging law firms, practicing lawyers, commercial companies, and individuals seeking legal assistance and insights primarily concerning the laws of the United Arab Emirates and other Gulf Arab countries.

Crucial Clarification of Service:

• Non-Practicing Status & Not Legal Representation: BH Consultancies is a legal consultancy, not a law firm. We do not practice law or appear in court on behalf of clients in any jurisdiction. All Services are provided on a consultancy basis from the United Kingdom. Dr. Abdulrahman Balhaj is a former lawyer in the UAE and is not currently a licensed, practicing lawyer in the UAE, the UK, or any other jurisdiction. Any reference to 'lawyer' or 'legal consultant' refers to the qualifications and past experience of our founder and does not imply a current license to practice law.
• No Attorney-Client Relationship: Your use of our Services does not create a solicitor-client or attorney-client relationship in the traditional, practicing sense. We operate as expert legal consultants providing analysis, guidance, and support.
• Consultant-to-Professional Relationship (For Law Firms): When providing services to practicing lawyers and law firms, we act as an external, specialist consultant. The client law firm retains all professional duties and responsibilities towards its own clients. Our input is advisory, and the client law firm is responsible for integrating our advice into its professional strategy.
• Guidance for Self-Representation (For Individuals): When we provide guidance to individuals on court procedures or electronic case registration, this is for informational purposes to assist a self-represented litigant. This guidance does not constitute legal representation. The individual is solely responsible for meeting all court deadlines, following correct procedures, and representing their own interests.
• Limitation on Jurisdictional Advice: Our services focus on the laws of the UAE and Gulf Arab countries. We do not provide advice on the laws of the United Kingdom or any other jurisdiction outside of this specified scope. Any information provided relating to other legal systems is for comparative purposes only and should not be relied upon as formal legal advice.

3. Client Obligations

To use our Services, you agree to:

• Provide accurate, complete, and current information as requested.
• Use the Services for lawful purposes only.
• Responsibility for Final Review and Use: Be solely responsible for the decisions you make and the actions you take based on our consultations. While we assist in drafting legal documents, the client (whether an individual or a law firm) bears the final and ultimate responsibility for reviewing, approving, and submitting these documents. The client must ensure that the final document accurately reflects their position and complies with all procedural requirements.

4. Fees, Payment, and Refunds

• Fees: The fees for our Services will be clearly stated at the time of purchase or in a direct quote.
• Payment: All payments must be made in full through the available payment methods before any Service commences.
• Refunds: Due to the nature of our consultancy services, payments are non-refundable once the service has commenced.

5. Confidentiality

We are committed to maintaining the confidentiality of the information you provide. We will not disclose any confidential information to any third party without your express consent, except as required by law.

6. Intellectual Property

All content on this website, including the "BH Consultancies" name and logo, is our property. Any reports, research, or drafted documents ("Work Product") we create for you are for your internal use only. You may not reproduce, resell, or distribute the Work Product for commercial gain without our prior written consent.

7. Disclaimer of Warranties and Limitation of Liability

• No Guarantee of Outcome: We make no representation, warranty, or guarantee as to the outcome of any legal matter.
• "As Is" Service: The Services are provided "as is" and "as available" without any warranties.
• Limitation of Liability: To the fullest extent permitted by law, BH Consultancies shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenues.
• Maximum Liability: In no event shall our aggregate liability for all claims relating to the Services exceed the total amount of fees paid by you to us for the specific service in question.

8. Indemnification

You agree to defend, indemnify, and hold harmless BH Consultancies and its founder from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Service; or (iii) any claim that your use of the Service caused damage to a third party.

9. Governing Law and Jurisdiction

These Terms shall be governed by the laws of England and Wales. You agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute.

We reserve the right to amend these Terms at any time by posting the new Terms on this site.

• صفة غير ممارسة وعدم التمثيل القانوني: "إتش للاستشارات" هي جهة استشارية قانونية وليست مكتب محاماة. نحن لا نمارس المحاماة ولا نمثل العملاء أمام المحاكم في أي ولاية قضائية. تُقدَّم جميع الخدمات على أساس استشاري من المملكة المتحدة. الدكتور عبد الرحمن بلحاج هو محامٍ سابق في دولة الإمارات، وهو حاليًا غير مرخص له بمزاولة مهنة المحاماة في الإمارات أو المملكة المتحدة أو أي مكان آخر. أي إشارة إلى "محامٍ" أو "مستشار قانوني" تشير إلى مؤهلات وخبرات مؤسسنا السابقة ولا تعني وجود ترخيص حالي للممارسة.
• عدم قيام علاقة محامٍ بموكله: استخدامك لخدماتنا لا ينشئ علاقة "محامٍ بموكله" بالمعنى التقليدي للممارسة. نحن نعمل كخبراء استشاريين قانونيين نقدم التحليل والتوجيه والدعم.
• علاقة استشاري بمتخصص (لمكاتب المحاماة): عند تقديم الخدمات للمحامين الممارسين ومكاتب المحاماة، فإننا نعمل كمستشار خارجي متخصص. يحتفظ مكتب المحاماة العميل بجميع واجباته ومسؤولياته المهنية تجاه موكليه. مساهمتنا استشارية، ومكتب المحاماة العميل هو المسؤول عن دمج مشورتنا في استراتيجيته المهنية.

3. التزامات العميل

لاستخدام خدماتنا، فإنك توافق على:

• تقديم معلومات دقيقة وكاملة وحديثة عند الطلب.
• استخدام الخدمات لأغراض مشروعة فقط.
• المسؤولية عن المراجعة النهائية والاستخدام: تتحمل المسؤولية الكاملة عن القرارات التي تتخذها والإجراءات التي تقوم بها بناءً على استشاراتنا. بينما نساعد في صياغة المستندات القانونية، يتحمل العميل (سواء كان فردًا أو مكتب محاماة) المسؤولية النهائية والكاملة عن مراجعة هذه المستندات والموافقة عليها وتقديمها. يجب على العميل التأكد من أن المستند النهائي يعكس موقفه بدقة ويتوافق مع جميع المتطلبات الإجرائية.

4. الرسوم والدفع واسترداد الأموال

• الرسوم: سيتم تحديد رسوم خدماتنا بوضوح عند الشراء أو في عرض سعر مباشر.
• الدفع: يجب سداد جميع المدفوعات بالكامل عبر طرق الدفع المتاحة قبل بدء أي خدمة.
• استرداد الأموال: نظرًا لطبيعة خدماتنا الاستشارية، فإن المدفوعات غير قابلة للاسترداد بمجرد بدء الخدمة.

5. السرية

نحن ملتزمون بالحفاظ على سرية المعلومات التي تقدمها لنا. لن نكشف عن أي معلومات سرية لأي طرف ثالث دون موافقتك الصريحة، إلا إذا كان ذلك مطلوبًا بموجب القانون.

6. الملكية الفكرية

8. التعويض

أنت توافق على الدفاع عن "BH Consultancies" ومؤسسها وتعويضهم وحمايتهم من وضد أي وجميع المطالبات والأضرار والالتزامات والخسائر والديون والتكاليف والنفقات (بما في ذلك على سبيل المثال لا الحصر أتعاب المحاماة) الناشئة عن: (1) استخدامك للخدمة والوصول إليها؛ (2) انتهاكك لأي بند من بنود الخدمة هذه؛ أو (3) أي ادعاء بأن استخدامك للخدمة قد تسبب في ضرر لطرف ثالث.

9. القانون الحاكم والاختصاص القضائي

تخضع هذه الشروط وتفسر وفقًا لقوانين إنجلترا وويلز. أنت توافق على أن محاكم إنجلترا وويلز سيكون لها الاختصاص القضائي الحصري لتسوية أي نزاع.

10. تعديل الشروط
